Terms & Conditions
1. Definitions
“Company,” “We,” “Us,” “Our” refers to Anwaar International Travel & Tourism, a licensed travel and tour operator in the Sultanate of Oman.
“Client,” “You,” “Your,” “Participant” refers to the person(s) booking and/or traveling on the tour.
“Tour” refers to the itinerary, services, and package as described in the brochure, website, or quotation.
“Group Tour” refers to a pre-scheduled tour with a fixed itinerary where individuals join a larger group of travelers. (Note: The specific number, e.g., 10+, can be defined per tour package, but defining it rigidly here can be limiting).
“FIT” (Free Independent Traveler) refers to a custom-designed tour for an individual, family, or private group, not part of a pre-formed larger group.
“Supplier” refers to any third-party provider of services such as airlines, hotels, transportation companies, guides, and activity providers.
2. Booking & Payment
Booking: A booking is confirmed only upon our written acceptance and receipt of the required deposit or full payment. The lead booker is responsible for the booking and warrants they are authorized to agree on behalf of all persons named and that all information provided is accurate.
Deposit: A non-refundable deposit of 20% of the total tour price is required to secure a booking. For some services (e.g., flight tickets, high-demand accommodation), a higher deposit may be required and will be specified in the quotation.
Final Payment: The full balance must be paid no later than 30 days before the tour departure date for Group Tours, and 15 days for FITs. For bookings made within these periods, full payment is required immediately upon confirmation.
Value Added Tax (VAT): All quoted prices are exclusive of the 5% Oman VAT. The applicable VAT will be added to the final invoice as per the Oman Tax Authority regulations.
Non-Payment: Failure to pay the balance by the due date will be treated as a cancellation by the Client, and the cancellation charges in Clause 4 will apply.
3. Prices & Surcharges
The Company reserves the right to amend published prices due to significant fluctuations in exchange rates, increases in fuel costs, taxes (including new or increased tourism fees), or other supplier costs.
All prices are quoted in US Dollars (USD) but may be payable in Omani Rials (OMR) at the prevailing exchange rate on the date of payment.
4. Cancellation by the Client
All cancellation notices must be received in writing. Cancellation charges are calculated from the day the written notice is received by the Company.
For Group Tours:
More than 60 days before departure: Full Refund.
59 to 30 days before departure: 50% of total tour cost.
29 to 15 days before departure: 75% of total tour cost.
Less than 15 days before departure or no-show: 100% of total tour cost.
For FITs:
Cancellation charges are specific to the suppliers booked (e.g., hotels, tours, transfers). The Client will be liable for any cancellation fees imposed by these suppliers. The Company will also apply an administrative fee of 10% on the total recoverable amount.
Non-Refundable Services: Please note that some services (e.g., discounted air tickets, special desert camp bookings, or museum permits) may be 100% non-refundable immediately upon booking.
5. Changes & Cancellation by the Company
Itinerary Changes: The Company reserves the right to modify tour itineraries, accommodation, or transportation due to unforeseen operational circumstances (e.g., weather, force majeure events, road closures, availability issues). We will endeavor to provide alternatives of a similar standard. No refunds will be made for minor or necessary changes.
Supplier Substitution: The Company reserves the right to substitute booked suppliers with others of equivalent or higher standard if necessary, without liability or obligation to refund.
Cancellation: We reserve the right to cancel a tour for reasons including, but not limited to, force majeure or failure to meet the minimum number of participants required for a Group Tour.
In such an event, the Client will be offered the choice of:
A full refund of all amounts paid.
An alternative tour of comparable standard.
6. Force Majeure
The Company shall not be liable for any failure to perform its obligations under this agreement if such failure results from circumstances amounting to Force Majeure as defined under the Omani Civil Code, including but not limited to acts of God, war, threat of war, terrorism, civil unrest, industrial disputes, natural disasters, fire, epidemics/pandemics, or any government action or restriction.
7. Client Responsibilities
Travel Documents: The Client is solely responsible for ensuring they possess a valid passport (with a minimum validity of 6 months from the date of entry), all necessary visas, vaccinations, and other required travel documents for the entire itinerary. The Company can provide guidance but is not responsible for visa issuance.
Travel Insurance: Comprehensive travel insurance is mandatory for all Clients. The insurance must cover cancellation, medical expenses, emergency evacuation, repatriation, and personal liability. Proof of insurance must be provided to the Company before the tour departure.
Health & Fitness: The Client must ensure they are medically and physically fit for the tour. Any conditions that may affect participation or require special assistance must be disclosed to the Company at the time of booking.
Conduct & Local Laws: The Client agrees to abide by the authority of the tour leader/guide and, importantly, to comply with all local laws, regulations, and respect the social customs and cultural norms of the Sultanate of Oman. The Company may terminate the tour of any Client whose behavior is deemed to cause danger, distress, or annoyance to others, without any right to refund.
8. Limitations of Liability
The Company acts as an intermediary and coordinator between the Client and various independent Suppliers (airlines, hotels, etc.). We exercise due diligence in selecting our Suppliers but are not responsible for any willful or negligent acts, omissions, or defaults of these third parties.
All travel arrangements are made subject to the conditions and limitations of liability imposed by the Suppliers, which may exclude or limit liability in accordance with international conventions and local laws.
To the fullest extent permitted by Omani law, the Company’s maximum liability to the Client, for any claim whatsoever, shall be limited to the amount paid for the tour package.
9. Claims & Complaints
The Company strives to resolve any issues promptly. Any complaint must be brought to the immediate attention of the local tour guide/representative during the tour to allow for a solution on the ground. If a problem cannot be resolved locally, the Client must submit a formal complaint in writing within 30 days of the tour’s end date.
10. Privacy Policy
The personal information you provide will be used solely for the purpose of making and providing your tour arrangements. We will ensure your data is stored securely and in accordance with the Sultanate of Oman’s Data Protection Law.
11. Media & Promotional Material
The Client agrees that the Company may use any photographs, videos, or other images taken during the tour in which the Client may appear, for promotional and commercial purposes, including on our website, social media, and brochures, without any obligation to compensate the Client.
12. Jurisdiction & Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the Sultanate of Oman. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Muscat Governorate, Sultanate of Oman.
